Article 2 – Purpose
Private boat trip services with a skipper departing from Cannes.
Any booking implies the unreserved acceptance of these Terms and Conditions (hereinafter "T&C") by the Customer.
Article 3 – Services
- Essential Package: max 9 passengers
- Luxury Package: max 11 passengers
Fuel is included for the Lérins Islands area. Any other destination (Monaco, Saint-Tropez, Saint-Raphaël, etc.) is subject to a specific quote.
Article 4 – Booking and Payment
Booking via secure platform (Stripe, Bókun). The booking is confirmed after full payment or deposit. The remaining balance must be paid no later than 48 hours before the service.
Article 5 – Pricing
Prices are quoted in euros, all taxes included.
Included:
- Boat
- Licensed professional skipper
- Fuel for the Lérins Islands area
- Safety equipment
Not included:
- Additional options
- Destinations outside the area
- External services
Article 6 – Customer Cancellation
- More than 24 hours before: full refund
- Less than 24 hours before: no refund
- No-show: full amount due
A rescheduling may be offered subject to availability.
Article 7 – Weather Conditions and Safety
The skipper is the sole decision-maker. In case of dangerous conditions:
- Priority rescheduling
- or full refund
The trip may be maintained in a sheltered area if conditions allow.
Article 8 – Liability
The Service Provider acts as a boat rental provider with skipper and not as a maritime carrier. The customer must comply with safety instructions.
The Service Provider shall not be held liable in case of:
- Force majeure
- Non-compliance with safety instructions
- Loss or theft of personal belongings
Article 9 – Safety and Life-Saving Equipment
The boat is equipped in accordance with current maritime regulations (Division 240).
Life jackets are available on board for all passengers, adults and children. For children, the customer agrees to communicate their age and weight in advance to ensure appropriate equipment is provided.
Wearing a life jacket may be made mandatory at any time by the skipper, particularly for safety reasons, weather conditions, or navigation.
Children remain at all times under the responsibility and supervision of an accompanying adult.
The customer agrees to comply with all safety instructions given by the skipper before and during navigation.
All safety equipment is regularly inspected to ensure a safe experience in compliance with standards.
Article 10 – Lateness / No-Show
Any delay reduces the trip duration without compensation. In case of no-show, the full amount is due.
Article 11 – On-Board Behaviour
The customer is responsible for any damage caused to the boat or equipment. Any dangerous or inappropriate behaviour may result in immediate exclusion from the trip, without refund.
Article 12 – Personal Data
Processing in compliance with GDPR. Collected data is used solely for booking management and service-related communications.
The Customer has the right to access, rectify, and delete their data by contacting: sortiebateau06@gmail.com.
Article 13 – Disputes
French law applies. Competent court: Nice.

Article 14 – Custom Services / Business Introducer (Broker)
For destinations outside the Lérins Islands (Monaco, Saint-Tropez, Saint-Raphaël...) as well as for events or large groups, Sortie Bateau 06 acts as a business introducer.
In this context:
- Referral to third-party service providers (shipowners, skippers, nautical companies)
- Contract concluded directly between the customer and the service provider
- Each provider is solely responsible for their own service
- Sortie Bateau 06 receives a commission and cannot be held liable for the execution
Article 15 – Final Provisions
If any clause is found invalid, the remaining clauses shall continue to apply. The applicable T&C are those in effect at the time of booking.
